Frazer Coogans advise licensees that
proper advice is essential during transition

MOST owners of licensed premises and holders of off-sales licences will be aware of the important changes now underway to licensing law in Scotland.

The transition or transfer period from the present alcohol licensing legislation, the Licensing (Scotland) Act 1976, to the new legislation, the Licensing (Scotland) Act 2005, started on 1 February 2008. The transition period will run for nineteen months, until the 1 September 2009. All licences and regular extensions under the ‘old’ system in operation on 1 February 2008, when the transition period begins, will automatically be extended to 1 September 2009.

Under the 2005 Act there are two sorts of licence, and licensees need both - a Premises Licence, a licence authorising the sale of alcohol on the premises, and a Personal Licence which authorises an individual person to supervise or authorise the sale of alcohol. An applicant for a Personal Licence must be in possession of the new, prescribed, Licensing Qualification.

To apply for a new Premises Licence under the 2005 Act, a licensee must submit to the Council an Application Form (and the appropriate fee), an Operating Plan, and a Layout Plan. The provisions for the form of the Layout Plan are very detailed, and it is important that appropriate professional assistance is sought to prepare an acceptable Layout Plan.

Although the Scottish Government have given the impression that the application for the new licences is a straightforward one which most licensees can deal with themselves, in reality licensees will require to instruct the appropriate property professional who can provide a properly prepared Layout Plan of the Premises, and also to consult with their independent legal adviser to discuss and prepare their Operating Plan and the Application Form. Careful consideration is required of the detail to be incorporated in the Operating Plan and Application Form to avoid damaging complications at a later date.

The new licensing regime and the transition procedures will require licensees to undertake a substantial amount of preparatory work in advance of the final lodging date in order to ensure that the Application meets the necessary standards. In addition to the professional fees involved, the application fees for the new licence are set at a much higher level than those under the 1976 Act, and the high costs and the complexity involved in the transitional application process have led some licensees to seriously consider closing down their businesses prior to the start of the new licensing regime.

Ayrshire solicitor urges Scottish Government
to reverse asbestos compensation judgement


An Ayrshire solicitor has expressed disappointment at this week’s House of Lords judgement blocking compensation for pleural plaques, an asbestos-related lung condition that accounts for as many as 75 per cent of all asbestos claims in the UK.


Norman Geddes is the senior partner in the Accident & Injury Claims Centre in Ayr, part of Frazer Coogans Solicitors.

He said: “It is disappointing that the House of Lords has ruled that people with pleural plaques shouldn’t be awarded compensation. The condition of pleural plaques, which causes thickening of the lung membranes, clearly indicates the presence of asbestos fibres in the lungs, and can lead to clinical depression caused by anxiety over that asbestos, which may in turn cause life-threatening illnesses to develop later.

“However, it is important to stress that, in spite of this ruling, people with mesothelioma, a malignant tumour in lung tissue caused by exposure to asbestos, are still entitled to receive compensation.”

In his House of Lords ruling, Lord Leonard Hoffman wrote: “Proof of damage is an essential element in a claim in negligence, and in my opinion the symptom-less pleural plaques are not compensatable.”

Norman Geddes commented: “This judgement can only cause further anxiety for people who are already living with the knowledge that their lungs have been irreparably scarred by asbestos, but who have not yet developed an even more serious condition. The Scottish Government must enact legislation urgently to remedy this most unjust situation.”

Local people advance at Frazer Coogans Solicitors

As part of the firm’s continuing expansion programme, leading Ayr-based solicitors Frazer Coogans have announced three new staff appointments.


Stuart Paterson (27), pictured above, formerly an assistant solicitor, has been promoted to the post of Associate.

An increasing amount of Stuart’s time is spent on domestic conveyancing, but his remit also includes family law and personal accident and injury claims.

Born in Ayr, where his father is a house builder and his mother a teacher, Stuart is a former pupil of Belmont Academy, and studied law at the University of Strathclyde and the Glasgow Graduate School of Law. He served his legal traineeship with Glasgow solicitors Cameron Macaulay.

Stuart and his fiancée Nicola are getting married in July, and will be returning to Ayr to live.


Carly Young (25) Pictured above, has completed her two-year legal traineeship with Frazer Coogans, and has now been appointed as an assistant solicitor with the firm.

Also born in Ayr, Carly went to school at Kyle Academy and studied law at Glasgow University and the Glasgow Graduate School of Law.

She said: “I am looking forward to continuing my legal career with Frazer Coogans, where I completed my traineeship.”

Carly specialises in commercial leasing and conveyancing.


Margaret Mackin (43) pictured above, was born in Muirkirk, and has worked at Frazer Coogans since 1988, during which time she has seen many changes, not least the introduction of information technology and the dynamic expansion of the firm in recent years.

“Staff numbers have doubled since I first came here,” she said. “They now stand at 21, including the three partners.

“I started off as the receptionist, and then trained as a cashier. In 1992, I obtained my diploma from the Society of Law Accountants in Scotland.”

Margaret has now been promoted to the post of Office Manager.

Elite businesses form a circle

THE CREAM of Ayrshire businesses are all set to link together to present a united online shop window to the world.

Membership of the Elite Ayrshire Business Circle will be limited to just one company in each business sector, although in the case of very localised businesses this may be increased to one in each of the three areas of North, East and South Ayrshire.

The founder of the Elite Ayrshire Business Circle is Norman Geddes, who is also senior partner with Ayr-based Frazer Coogans Solicitors.

A new company, 1MarketPlace Ltd, has been set up to run the Circle.

Norman said: “This is an exciting opportunity for Ayrshire businesses. A top expansion-minded company in each business sector will be invited to join a circle of like-minded can-do people who are interested in promoting Ayrshire as a whole, as well, of course, as publicising their own individual enterprises.

New staff appointment at Frazer Coogans Solicitors of Ayr

LEADING Ayrshire solicitors Frazer Coogans are pleased to announce the appointment of Stuart Paterson (26) to join their legal team.

Stuart’s remit will include conveyancing, family law, and personal accident and injury claims.

Born in Ayr, Stuart is a former pupil of Belmont Academy, and studied law at the University of Strathclyde and the Glasgow Graduate School of Law. He served his legal traineeship with Glasgow solicitors Cameron Macaulay.
